Morgan Stanley’s recent $16 million racial discrimination settlement has been questioned by several former and current financial advisors of the firm. Last February, the settlement won preliminary approval in a northern California Court. The objectors contend that the settlement should not receive class action status and final approval until plaintiffs are more involved in the process. They claim lawyers brokered the deal without the approval of about 1,200 Latino and African American employees.
The dissenting employees said “Clients, not lawyers, own their claims” and that because Morgan Stanley had compromised with lawyers instead of their “real opponents,” they would “never know what agreement would have resulted.” The contenders’ complaint was filed April 28, 2008. The final verdict is scheduled for a mid-June decision.
